1. About these terms

These Terms of Service ("Terms") govern your use of Tattoo Planner, a studio management platform operated by Tattoo Planner B.V. ("we", "us", "the Company"). By creating an account or using the platform, you agree to these Terms.

If you are using Tattoo Planner on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2. The service

Tattoo Planner provides a cloud-based studio management tool that includes appointment scheduling, online bookings, client management, file storage, email and SMS reminders, and analytics. Feature availability depends on the subscription plan you choose.

We reserve the right to update, improve, or discontinue features with reasonable notice. We will not remove core functionality from an active plan without offering an equivalent alternative or a right to cancel.

3. Account registration

You must register an account to use Tattoo Planner. You agree to:

• Provide accurate and complete information during registration.
• Keep your login credentials confidential and not share them with third parties.
• Notify us immediately at [email protected] if you suspect unauthorised access to your account.

You are responsible for all activity that occurs under your account.

4. Subscription and billing

Tattoo Planner is offered on a monthly or annual subscription basis. Prices are listed in euros and exclude VAT unless stated otherwise. Current plans:

• Artist: €19/month — 1 user
• Team: €29/month — up to 3 users
• Studio: €39/month — unlimited users

Subscriptions renew automatically at the end of each billing period. You will be charged using the payment method on file. We will send a billing notification before each renewal.

Prices may change. We will give at least 30 days' notice of any price increase, and you may cancel before the new price takes effect.

5. Cancellation and refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain access until then.

We do not offer refunds for partial billing periods. If you cancel mid-month, your account remains active until the end of the month you paid for.

If you are an EU consumer and you cancel within 14 days of your first subscription purchase (the statutory cooling-off period), you are entitled to a full refund provided you have not made material use of the service.

6. Acceptable use

You agree to use Tattoo Planner only for lawful purposes and in accordance with these Terms. You must not:

• Use the platform to process, store, or transmit illegal content.
• Attempt to gain unauthorised access to any part of the platform or its infrastructure.
• Reverse-engineer, copy, or create derivative works based on the platform.
• Use the platform in a way that could damage, overload, or impair its performance.
• Resell or sublicense access to the platform without our written consent.

We reserve the right to suspend or terminate accounts that violate these rules.

7. Your data

You retain ownership of all client data and content you upload to Tattoo Planner. By uploading content, you grant us a limited licence to store and process it solely to deliver the service.

We process your data in accordance with our Privacy Policy, which forms part of these Terms.

Upon account cancellation, you may request an export of your data within 30 days. After that period, data may be permanently deleted.

8. SMS and email messaging

Tattoo Planner enables you to send appointment reminders to your clients via email and SMS. You are responsible for obtaining the necessary consent from your clients before sending marketing or reminder messages, in accordance with GDPR and applicable local laws.

SMS messages are charged on a pay-as-you-go basis on the Artist plan. Rates are shown in your account settings. Unused SMS credits are non-refundable.

9. Uptime and service levels

We aim to keep Tattoo Planner available 24/7. We target 99.5% monthly uptime, excluding scheduled maintenance, which we will announce in advance where possible.

In the event of extended downtime exceeding 24 consecutive hours, you may be entitled to a service credit. Contact us to request a credit.

10. Intellectual property

Tattoo Planner and all associated software, design, and content remain the exclusive property of Tattoo Planner B.V. Nothing in these Terms transfers any intellectual property rights to you.

You may not use our name, logo, or trademarks without prior written permission.

11. Limitation of liability

To the maximum extent permitted by applicable law, Tattoo Planner B.V. is not liable for indirect, incidental, consequential, or punitive damages arising from your use of the platform, including lost revenue or data loss.

Our total liability to you for any claim arising under these Terms is limited to the fees you paid in the three months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under EU law.

12. Termination

We may suspend or terminate your account if you materially breach these Terms and fail to remedy the breach within 14 days of written notice. We may also terminate immediately for serious violations such as illegal activity or security breaches.

You may terminate your account at any time per Section 5.

13. Governing law and disputes

These Terms are governed by the laws of the Netherlands. Any disputes will be submitted to the exclusive jurisdiction of the courts of Amsterdam, without prejudice to your rights as a consumer under the laws of your country of residence.

For disputes as an EU consumer, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Changes to these terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the platform after the effective date constitutes acceptance of the revised Terms. If you do not accept the changes, you may cancel your subscription before they take effect.
